DIVORCE ONLINE - WOMEN CAN REPRESENT THEMSELVES IN A DIVORCE
By Scott Morgan
Many
women facing divorce often feel overwhelmed. This
is why they want a lawyer to handle it. They aren't
coping very well and just want the attorney or lawyer
to "take care of it". If you can afford
this luxury, then by all means engage a lawyer.
What
about where you can't afford to incur large legal
fees? You're pretty much left with no alternative
but to represent yourself. On this page you will find
links to divorce online and divorce free online papers
(including a divorce form free online). This doesn't
mean that you can't still get or need some help and
advice from an attorney though, if you need it.
When
most people say they "want a divorce", they
are referring to the whole gamit of related Family
Law issues that often go along with the desire to
dissolve the marriage. Consequently, how simple or
complicated a divorce is depends, not only on the
laws in your State or country but your own personal
circumstances as well. If you have other issues such
as child custody, visiting rights or property settlement
to resolve, then your divorce will not just involve
a straight dissolution of the marriage. Divorce isn't
just filling out forms and filing them. It's also
about legal language, legal procedure and most importantly,
resolving outstanding family law issues with your
spouse.
This means that you will have decisions you need to
make. You may also want these decisions to be legally
binding. Often the signing of a marital settlement
agreement, for example, is not sufficient to constitute
a legally enforceable agreement. The agreement may
have to be approved by the court.
While
you will find links to online divorce forms and kits,
we strongly suggest you read the article, "Hire
Divorce Lawyer or Use Online
Divorce Forms?"
by Scott Morgan, first.
Divorce
is a worrying and scarey thing for many people. They
would rather avoid it if they could. The majority
of people simply don't like change and would prefer
not to think about their case. They want the lawyer
to worry about it ...... so they don't have to!
While
this is understandable, the reality is that even a
lawyer can't make these decisions for you. An attorney
can only act on your instructions. Bottom line - with
or without a lawyer, you will still have to face these
issues and decide what your position is. You will
still have to collate all the relevant information
and make your own decisions.
Approximately
93% of all contested family law matters never go to
trial. They are resolved by way of a negotiated settlement.
In other words, whether you use a lawyer or not, it
is likely that you will end up negotiating the terms
of any settlement yourself. The real benefit of an
attorney has more to do with making sure you know
what your legal rights and options are, so you can
then make informed decisions. If you can find this
information out another way, then why use a lawyer
at all? Well, there is another reason .... so that
your court documents are properly prepared and the
correct court procedure and steps are followed.
However,
there are a couple of options open to you if you can't
afford or would prefer not to use an attorney. One
is to contact
